Marc Gann Wins Acquittal for Client in Felony DWI Case
CGMB Founding Partner Marc Gann has won a full acquittal of all charges for his client in a serious felony DWI case on Long Island. His client, a 49-year-old mother of 2 teenage boys, was charged with a felony DWI and Endangering the Welfare of a Child for allegedly operating her vehicle in an intoxicated condition with her 15-year-old son in the car. She and her husband had taken the boys to a concert at Jones Beach last summer for their birthdays. After she left the concert, she was involved in a minor fender bender on the way home. She called 911 and was arrested shortly after police arrived. Thereafter, she submitted to a breath test that registered as a .09% BAC.
Marc’s defense was successful in showing that the police did not follow proper protocols, exaggerated or prevaricated, and that the breath results were not reliable – resulting in his client being acquitted of all charges by jury verdict on August 12. The full acquittal was a significant case win for both Marc and his client, with Marc presenting critical evidence to convince the jury to return a verdict of Not Guilty on all charges – clearing his client’s name and enabling her to avoid having the stigma of a felony conviction on her record for the rest of her life.
